Company Holiday Parties: Reducing Risk of Sexual Harassment and Other Claims

As the holiday season approaches, companies prepare to host their annual holiday celebrations. Although employers have good intentions in hosting holiday parties, these celebrations can create environments for unwanted advances or comments, particularly when alcohol is involved. These instances may put your business at risk, especially for sexual harassment claims under Title VII of the Civil Rights Act of 1964. An employer may also risk liability under Title VII for religious discrimination if its employees feel that attending such event may have religious undertones which they do not share.
There are many different scenarios that could create risk for your business. In order to reduce exposure, employers can take simple preventative measures such as 1.) re-publishing and re-distributing the company’s sexual harassment policy, 2.) reminding employees to be respectful and professional even if the event is after work hours and off-site, 3.) training managers about expected behavior guidelines, and 4.) monitoring alcohol consumption. As always, employers should strive to be inclusive of all employees and respectful of their religious beliefs. For this reason, employers should include all of its employees in the planning of the holiday party.
Taking these preventative measures can set a professional tone for your holiday party and can help prevent sexual harassment.
